3A. Biometric Data (BIPA)
Call recordings processed through the VAI Talon platform may contain voiceprints, which are classified as biometric identifiers under the Illinois Biometric Information Privacy Act (BIPA) and potentially under the laws of other states. We treat voiceprint data with the following protections:
- Purpose. Voiceprints and voice data are collected solely for service delivery, quality assurance, compliance, and platform improvement. We do not sell, lease, trade, or otherwise profit from biometric identifiers.
- Retention. Biometric data is retained only as long as necessary for the original purpose of collection, or for a maximum of three (3) years from the date of last interaction, whichever comes first, unless a longer period is required by law.
- Destruction. Biometric identifiers are permanently and irreversibly destroyed at the end of the applicable retention period using industry-standard methods.
- No Third-Party Sharing. We do not share biometric data with third parties except as required by law or as necessary to deliver our services under strict confidentiality obligations.
- Illinois Residents. If you are an Illinois resident interacting with a VAI Talon-powered call, you have the right to request information about our biometric data practices, request deletion of your biometric data, and submit a complaint if you believe your BIPA rights have been violated. 3B. Call Recording & AI Interaction Data
VAI Talon records telephone calls and logs SMS messages and chat interactions processed through our platform. This data may include the content of conversations, caller identification information, timestamps, and AI-generated transcripts and summaries.
Recording Notice: Calls made through the VAI Talon platform are recorded for quality assurance, compliance, training, and service improvement purposes. By using our platform or interacting with a business that uses VAI Talon, you acknowledge that calls may be recorded. In states that require all-party consent to recording — including California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington — a recording disclosure is provided at the start of each call.
AI Interactions: Our platform uses artificial intelligence to conduct voice, SMS, and chat communications. When you interact with VAI Talon, you are communicating with an AI system. In compliance with applicable state bot disclosure laws, including California Business & Professions Code §§17940–17945, our AI will identify itself as an AI when asked.
4. Data Security
We implement industry-standard security measures to protect your personal information, including encryption in transit (TLS) and at rest, access controls, and regular security reviews. However, no method of transmission over the internet is 100% secure.
5. Data Retention
We retain your personal information for as long as necessary to provide our services and comply with legal obligations. You may request deletion of your data at any time by contacting us.
6. Your Rights
VAI Talon operates across all 50 states and is committed to honoring the privacy rights available under applicable law. Depending on where you reside, you may have the following rights:
- Access. Request a copy of the personal information we hold about you.
- Correction. Request correction of inaccurate or incomplete data.
- Deletion. Request deletion of your personal data, subject to legal retention requirements.
- Opt-Out of Sale or Sharing. We do not sell your personal information. If this changes, we will update this policy and provide a clear opt-out mechanism.
- Opt-Out of Marketing. You may opt out of marketing communications at any time by replying STOP to any SMS, using the unsubscribe link in any email, or contacting us directly.
- Data Portability. Request a portable copy of your personal data in a commonly used format.
- Non-Discrimination. We will not discriminate against you for exercising any privacy right.
California Residents (CCPA/CPRA): If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act, including the right to know the categories of personal information collected, the right to opt out of the sale or sharing of personal information, the right to limit use of sensitive personal information, and the right to non-discrimination. Other State Residents: Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana, Iowa, Indiana, Tennessee, and other states with enacted privacy laws may have similar rights. Contact us to exercise your rights and we will respond in accordance with the law applicable to your state.
EU/EEA & UK Residents (GDPR): If you are located in the European Union, European Economic Area, or United Kingdom, you have rights under the General Data Protection Regulation, including the right to access, rectify, erase, restrict processing, data portability, and to object to processing. 7. Cookies & Analytics
We use cookies and similar tracking technologies to enhance your experience on our site. 8. Telephone Communications & TCPA
When you provide your phone number through our website or platform, and expressly consent to be contacted, VAI Talon may contact you via autodialed or AI-powered calls and/or SMS messages. By providing your phone number and consenting, you agree to receive such communications even if your number is listed on a state or national Do Not Call registry.
You may opt out of future calls or texts at any time by replying STOP to any SMS message, verbally requesting removal during a call, or emailing support@vaitalon.com. Opt-out requests will be honored within the timeframe required by applicable law. Message and data rates may apply.
VAI Talon maintains records of all consents and opt-outs as required by the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations.
9. Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites and encourage you to review their privacy policies.
10. Children's Privacy
Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children.
10A. Data Breach Notification
In the event of a security breach that compromises the confidentiality, integrity, or availability of your personal information, VAI Talon will notify affected individuals in accordance with applicable state and federal breach notification laws. All 50 states have enacted data breach notification statutes, and notification timelines vary by state — ranging from as few as 30 days (Florida, Washington) to "expedient" notification (California). We will:
- Investigate and contain the breach as quickly as possible upon discovery
- Notify affected individuals by email or, where required, by written notice, within the timeframe required by the law of their state of residence
- Notify applicable state regulators and, where required, credit reporting agencies, in accordance with state law
- Provide notice to the media in states that require it when the breach affects more than 500 residents of that state
- Maintain a log of all security incidents and breach notifications
